General Condition of SaleBy accessing and placing an order with PolygonCloud (XenoNetwork SAS), You confirm that You are in agreement with and bound by the terms and conditions.

1. Service configurationWe are not responsible for the configuration of a customer's service. We are only responsible for the basic hosting service. A customer must be able to customize their own service prior to purchase. Being unable to customize your service is not a valid reason to request a refund. An agent will help you remove any customizations (at the risk of data loss) you have made to your service if you wish. We can offer you a quote to customize your service, but this may involve data loss and possible alterations. As stated above, we and our agents accept no responsibility for any damage to or loss of data from your service.
2. Availability and performanceWe do our best to provide 100% uptime. Unfortunately we cannot provide this all the time, you will be notified if we need to take your server down for actions such as scheduled maintenance. Some services are known to be prone to failure, we take no responsibility for any data loss that may occur. If your service crashes, please restart it.
3. RefundYou may request a refund within 2 days of purchase, using Paypal or Credit Card only. Once the refund has been made, the service will be closed and the data will no longer be recoverable. No refund can be made for an automatic payment that has not been deactivated. If you wish to deactivate the automatic payment, please contact us and we will do it for you. We do not refund PayPal fees and Credit Card.
4. PayPal disputesWe have no tolerance for PayPal disputes, anyone claiming a dispute will have their account suspended immediately and their services terminated without refund. This cancels the 2-days grace period and no refund will be possible. Your account will then be banned from our services for life.
5. Service deliveryThe installation of your services is instantaneous, but in some cases there may be a delay, requiring additional time. You can contact support to speed up delivery. Compensation will be paid for delays of 5 days or more.
6. CancellationThe customer is responsible for creating a cancellation request for their service, failure to create a request will result in new invoices being generated and therefore billed from the account holder's payment method. All payments made prior to cancellation will not be refunded, unless they are still within their 3-days grace period.
7. Billing cyclesWe offer a monthly (1 month) server hosting billing cycle. At any time, you can choose to change your billing cycle, but the change will not take effect until the next billing date / plan renewal. A fee of €2.00 inc. VAT is charged for each billing cycle change.
8. Data loss / preventionThe Platform retains your data for as long as is necessary to provide its services or support to you. To the extent reasonably necessary or required to satisfy legal or regulatory obligations, settle disputes, prevent fraud and abuse or enforce our terms and conditions, we may also retain some of your information as necessary, even after you have closed your account or we no longer need it to provide our services to you.
9. Customers are not allowed toResell our services. Use any service for malicious actions or activities. Modify or read files outside its server. Use our services as a mass storage facility.
10. DDoSWe take no responsibility for downtime following an attack; our dedicated machines are designed to withstand a certain amount of unwanted traffic.
11. Server terminationWe reserve the right to terminate your server without notice at any time. A refund will generally be given, but not guaranteed, to anyone whose account has been terminated. Furthermore, in the event of non-use of the server we reserve the right to remove it (temporarily), all data will be saved. You can ask for your server back at any time, and any remaining days will be added to your account. Please note that this action is very rare, and we make every effort to contact the customer concerned.
12. LiabilityPolygonCloud (XenoNetwork S.A.S) is not responsible for donations / payments that are in exchange for virtual or physical goods on a server. By purchasing a server, you agree to exclude all liability of PolygonCloud (XenoNetwork S.A.S) regarding customer service / payments and disputes.
13. Changes to the general terms and conditions of saleWe reserve the right to terminate your server without notice at any time.
