Preamble The company XENONETWORK SAS is a simplified joint-stock company with a capital of 100 euros, registered under number 905 155 180 with the Douai Trade and Companies Register. Its head office is located at 26 rue Louis Aragon, 59286 ROOST-WARENDIN. XENONETWORK SAS (hereinafter the "Provider") is a company specializing in hosting services for professionals and individuals. If a client wishes to use the services of XENONETWORK SAS, they must accept these general terms and conditions of hosting (GTC), which apply to business relationships between the client and XENONETWORK SAS. If the client is a professional, they waive their own general terms of purchase. XENONETWORK SAS asserts that it has the necessary skills and expertise to provide hosting services, and the parties agree to execute this agreement in an honest and fair manner. The client also agrees to comply with these GTC. In case of incapacity, the clauses applied to the client are also applied to their legal representatives (Parents or legal guardians). XENONETWORK SAS may operate under several trade names. In this case, these terms apply in the same way as if the sale had been concluded under the name PolygonCloud.
Article 1: PurposeThese general terms and conditions of sale detail the rights and obligations of PolygonCloud and its Client in the context of the sale, rental, or provision of services.
The use of our services implies acceptance of these General Terms of Use (GTU). PolygonCloud reserves the right to modify these terms without prior notice to its clients. It is therefore the Client's responsibility to stay informed of any changes to this document. To facilitate access, PolygonCloud provides a link to this document at the bottom of the homepage of its website.

Article 2: PricingUnless stated otherwise, prices are expressed in euros (EUR, euro, €) and include all taxes (TTC). The prices of products and services sold are those in effect at the time of the order. If the price of a product or service changes after the order, the billed amount will remain unchanged, except in case of changes in taxes included in the TTC price or additional fees related to the use of a payment method. However, PolygonCloud reserves the right to apply a price increase or decrease on already subscribed services on a one-time basis, with a 1-month notice. It is understood that if the characteristics of a service change, its price may also be adjusted.
PolygonCloud reserves the right to change prices at any time. The services ordered are considered active as soon as PolygonCloud begins the service setup process. All our services can be canceled and refunded at any time in accordance with the refund policy, except for custom, tailored, or out-of-catalog services. The account balance is non-refundable, but a payment made to provision this balance can be refunded within 24 hours of the transaction. The Client is free to renew or not renew their service, as all our services are without commitment.
PolygonCloud reserves the right to change prices at any time. The services ordered are considered active as soon as PolygonCloud begins the service setup process. Article 3: Compliance with Legal ObligationsAny abusive or illegal use of the service in violation of French law will result in its permanent removal without refund, as well as a complaint to the competent authorities. The Client is prohibited from engaging in any hacking or intrusion activities using a service provided by PolygonCloud. It is the Client's responsibility to hold the necessary licenses for the software and operating systems they use.
By way of example, here is a non-exhaustive list of illegal activities:
- Denial of service attack
- Port scanning
- Sending spam or phishing emails
- Hosting child pornography content
- Hosting content violating copyright laws
- Publication of personal data (Doxxing)
- Publication of stolen data (database leaks)
- Publication of antisemitic, racist, xenophobic, homophobic content, inciting hatred, or glorifying terrorism
In the event of a judicial requisition, PolygonCloud agrees to cooperate with public authorities. If PolygonCloud is subject to legal action due to the illegal use of a service provided to the Client, the Client will be liable to compensate PolygonCloud for all legal defense costs and additional expenses related to this procedure.

Article 4: LimitationPolygonCloud provides services that may be shared among multiple users. Therefore, each Client must use them reasonably, meaning avoiding any overconsumption that could harm other users, as well as the hardware or network infrastructure. Consequently, even when complying with regulations, PolygonCloud prohibits its clients from using its service to:
- Offer mass anonymization services (VPN, Proxy), unless the usage is exclusive to the Client
- Host seedboxes
- Use P2P file-sharing devices, such as Torrent or Emule
- Mine cryptocurrency (including using storage)

Article 5: ResponsibilityJustification for the use of the service provided by PolygonCloud in violation of the Terms of Use (CGU), even for testing or on infrastructure belonging to the Client, is not acceptable. Regardless of the service provided by PolygonCloud, the Client remains fully responsible and must assume all consequences, including in the event of service compromise. In the case of shared service, only the account holder associated with the service is responsible for its use. If a Client uses a service in violation of the Terms of Use (CGU), PolygonCloud reserves the right to suspend or terminate the service without refund. In the event of damage to PolygonCloud resulting from misuse of the service, the company may claim damages. The Client is responsible for the service made available to them, even if they suffer economic, material, or physical damage related to this service.
Article 6: Service QualityPolygonCloud provides quality service to its clients. However, technical issues may arise beyond our control. In case of an issue, whether attributable to PolygonCloud or the Client, the Client cannot demand compensation. However, PolygonCloud remains conciliatory and may, in case of an issue for which it is responsible, offer a commercial gesture.
PolygonCloud commits to deploying all necessary means to prevent problems that could affect its clients. In case of difficulty, customer service is available, although PolygonCloud cannot guarantee a specific response time. However, the company commits to providing a quick response within reasonable timeframes. Support is limited to issues specifically related to the services provided, and PolygonCloud does not provide support for the use or installation of servers. It is therefore the Client’s responsibility, at the time of purchase, to be able to configure and use the service autonomously. In interactions with customer service, any behavior from the Client that hinders the proper execution of support may result in blocking access to customer service, or even suspension of the account if such behaviors are repeated. Examples of unacceptable behaviors include: insults, defamation, racist, homophobic remarks, etc.

Article 7: ConfidentialityPolygonCloud commits not to accessing the hard drives of its clients’ servers, except in cases of maintenance or technical necessity. PolygonCloud and the Client agree to respect the confidentiality of private messages and the secrecy of correspondence. In accordance with the law of January 6, 1978 (article 27), known as the "Data Protection and Liberties" law, you have the right to access and correct your personal data. PolygonCloud commits to respecting the privacy and confidentiality of its clients and provides a "Privacy Policy" page, accessible from the bottom of the homepage, to summarize the data collected and the reasons for its collection. PolygonCloud’s confidentiality commitment does not apply when a judicial authority demands the disclosure of a client’s data.
